In order to help young lawyers grow up, at 14:00 on June 1, King&Capital's "Young Lawyers Sharing Meeting" was held in a youthful atmosphere. Cai Kangmiao, Feng Wang, Zhao Ruxuan (trainee lawyer), Zhu Yuanxiao and other four young lawyers gave lectures on the subject, and five lawyers, including part-time lawyer of King&Capital, associate professor of Chinese Academy of Social Sciences, Gao Huiyun, senior adviser of finance and tax, Zhao Qilong, senior partner, Sun Yanhui, senior partner, and Xu Wei, partner, were invited to give guidance and comments. Cai Kangmiao
At the sharing session, Ms. Cai Kangmiao gave a lecture on "Summarization of Experience in Handling Foreign Divorce Cases", in which she recounted the ups and downs of the case process, explaining hot issues such as domestic application for recognition of foreign divorce judgments, and how to litigate for divorce in China when the person is outside the country.
Feng Wang
Combining relevant cases, Mr. Feng Wang analyzed the root causes of the differences between criminal and civil factual determinations, the differences in judgment standards between the two, and the reasons for non-determination in practice, and shared his thoughts on how to avoid civil judges from being unduly influenced by criminally adjudicated facts.
Zhao Ruxuan
Ms. Zhao Ruxuan, a trainee lawyer, combined her experience in knowledge management with relevant cases and systematically shared her concise and efficient working methods in "legal search and case search", which provided references for young lawyers to improve their working efficiency.
Mr. Zhu Yuanxiao
Finally, Mr. Zhu Yuanxiao combined with specific cases to give a professional interpretation on "common dispute types of equity transfer disputes" and their solutions, including the validity of share transfer agreement which violates shareholders' preferential rights or sells one share for two shares, and common disputes such as undisclosed external debts and termination of share transfer agreement.
The five commenting lawyers spoke highly of the young lawyers' lectures on this topic, and the four lawyers focused on specific legal issues, systematically explained the ideas of solving typed problems, with clear logic, strong practicality and fluent expression, reflecting the high professional quality and business ability of the young lawyers in King&Capital. The five lawyers also provided one-by-one guidance to the sharing of each young lawyer.
Ms. Men Jinling
For example, Ms. Men Jinling reminded that when discussing legal issues, one should pay attention to differentiating between different concepts such as "fact" and "opinion", "contingency" and "actuality", and to start from the concept of "fact" and "opinion". Zhao Qilong
From the perspective of civil and commercial theory and practice, Mr. Zhao Qilong explained the principle of differentiation between contract validity and contract performance in China, and the similarities and differences with the relevant provisions of the German Civil Code, and introduced and shared a difficult and complex remand case he represented.
Ms. Gao Huiyun
Ms. Gao Huiyun drew attention to tax compliance issues from the perspectives of tax treatment of equity transfer prices under different circumstances, how to pay taxes on betting agreements, and the impact of asset appraisal reports on taxes.
Sun Yanhui
Mr. Sun Yanhui provided guidance on the logic of fact-combing, presentation of key contents, and interspersing of cases from the audience's perspective, and introduced and exchanged views on a difficult and complicated equity dispute case handled by him.
Xu Wei
Mr. Xu Wei shared his thoughts on the development direction of young lawyers, the support that the firm can provide, and the follow-up of the sharing session.
Scene of the meeting
At the sharing meeting, both young lawyers shared their case experience and thoughts around specific issues, and senior lawyers gave timely guidance and feedback on legal thinking, different logic of criminal and civil cases, practical experience in case handling, and methods of expression in lectures, etc., which provided a "brainstorming" moment for young lawyers and senior lawyers to exchange and discuss and learn from each other. The moment of "brainstorming" is provided between young lawyers and senior lawyers. Participants have expressed that they enjoy the process of collision of ideas and full communication, and hope that such activities will be held more often in the future.
