Lawyer Cai Kangmiao Invited to Teach Daxing Rural Revitalization Youth on Live E-commerce Laws and Regulations

On September 3, King&Capital Law Firm lawyer Cai Kangmiao was invited to give a lecture to thirty Daxing rural revitalization youths on the laws and regulations involved in live broadcasting e-commerce, with the title of "Laws and Regulations Related to Internet Marketing", and the course was unanimously praised by all of them.

The course mainly includes the first part: recognize the "law", the second part: the People's Republic of China Advertising Law, the People's Republic of China E-commerce Law, the "Internet live service management regulations" to focus on the law crosstalk, on the "People's Republic of China Advertising Law" in conjunction with the current concerns about the content of the advertisement false propaganda, The Advertising Law of the People's Republic of China analyzes the relevant legal responsibilities in light of the current concerns about false propaganda in advertisements, disparagement of peers, celebrities being punished as spokespersons, live broadcasting overturning, and false propaganda; and analyzes the risk hints in the E-Commerce Law of the People's Republic of China, which stipulates that e-commerce operators are obliged to provide the original contracts and transaction records and need to keep them for three years. The legal consequences of e-commerce operators selling goods or providing services, failing to fulfill contractual obligations or fulfilling contractual obligations not in accordance with the agreement, or causing damages to others are analyzed from the perspective of administrative, civil and criminal liability; and the Internet live broadcasting service providers shall record the content and log information released by users of the Internet live broadcasting service and keep them for sixty days in the "Provisions on the Administration of Internet Live Broadcasting Services". Part III: Analysis of the Administrative Provisions on Internet Live Streaming Services from the perspective of civil and criminal liabilities.

Part III: Interim Measures for the Administration of Internet Advertising, Consumer Protection Law, Food Safety Law of the People's Republic of China, Anti-Unfair Competition Law and other laws and regulations, combined with the needs of the students who will be engaged in the live broadcasting e-commerce industry of the popularization of the law, in the form of case studies, video playback of the key laws and regulations interpretation.

At the end of the lecture, the students asked questions about the advertising compliance, the use of packaging logo and the form of labor relations in the live broadcasting industry mentioned during the lecture, and the lawyers answered them one by one.
