King&Capital Attorneys Invited to Attend Seminar for Experts on Administrative Enforcement of Intellectual Property Rights

On January 13, 2023, a seminar for experts on administrative enforcement of intellectual property rights was held under the guidance of the State Administration of Market Supervision and Administration and hosted by the China Intellectual Property Research Society (CIPRS). Ms. Fei Wang, Senior Partner of King&Capital Law Firm, was invited to attend the meeting as an expert representative.

The purpose of this meeting is to gather experts' wisdom, study and discuss the determination of trademark hoarding and malicious registration, and coordinate and promote the enforcement of intellectual property rights. The Law Enforcement and Inspection Bureau of the State Administration for Market Supervision and Administration (SAMSA), China Intellectual Property Research Association (CIPRA), Department of Intellectual Property Protection of the State Intellectual Property Office (SIPO), Trademark Office of the State Intellectual Property Office (SIPO), and Beijing Market Supervision and Comprehensive Enforcement Unit (BMCCEU) were the participants of the conference.

The meeting centered on the discussion of four topics in the order of "the manifestation of malicious application for trademark registration; the applicant does not use for the purpose and the determination of malicious registration; the determination of the conditions that the trademark agency knows or should know; the determination of the conditions of malicious hoarding of trademarks". Participating expert representatives expressed their views on the above issues from their own roles and experiences, combined with reference cases.

Ms. Wang Fei, as a professional intellectual property and competition lawyer, shared her views on the manifestations and conditions for the determination of bad faith trademark application in practice, taking into account the reference cases and her experience in the field. In the discussion session, the experts exchanged views on specific cases from practical and theoretical perspectives, which resulted in a brilliant collision of views and formed useful reference materials for the determination of trademark hoarding and malicious registration in the administrative enforcement of intellectual property rights.
