The 10th "King&Capital Cup" Criminal Moot Court Competition of China University of Political Science and Law ended successfully.

On May 7, 2023, the 10th "King&Capital Cup" Criminal Mock Trial Competition of China University of Political Science and Law, which was fully supported by Beijing Kyoto Law Firm, came to an end. The competition lasted for more than a month, and the lawyers of King&Capital Law Firm participated in each section of the competition and commented on the wonderful performance of the students.

Main Court Points Competition

From April 8 to April 22, 2023, "King&Capital Cup" Criminal Moot Court Competition was successfully held in the main court points competition, which was divided into six games and lasted for three weeks. (Ordered by the number of matches)

King&Capital Law Firm lawyers Sun Guangzhi, Nie Sufang, Xiang Shujing, Tang Jianbin, Li Zhiguang, Peng Jiyue, Zhang Xiaofeng, Zang Desheng, Xu Wei, Cao Shuchang, and Xia Jun were present at the competition and acted as the members of the panel, commenting on the performance of the students in the courtroom.







Final round of the main court

On May 7, 2023, the final of the 10th King&Capital Cup Criminal Mock Trial Competition was held in Changping Campus of China University of Political Science and Law. Ms. Xu Ying, senior partner of King&Capital Law Firm, attended and acted as a judge to comment on the performance of the students. The competition went through ten stages, including court session, court investigation, court debate, guest commentary and award ceremony.


First, the public prosecutor read the indictment, charging the defendant Yuan Sicheng with contract fraud, the defendant did not recognize the facts and charges. The defense argued that the indictment accuses the defendant of contract fraud, the facts are unclear, the evidence is insufficient, and the applicable law is improper. Then, the prosecution and the defense questioned the defendant on relevant issues one after another. The defendant made a statement of the basic facts of the case, and did not admit that it constituted contract fraud.

In the court investigation, the prosecution presented a series of evidence and applied for the witness Wu Jia to appear in the court, the defense on the prosecution's evidence for cross-examination and additional part of the evidence. Both sides after several rounds of evidence, fully expressed their own views.

Court debate session, the prosecution argued that the defendant Yuan Sicheng fictional professional identity and image, the implementation of deceptive behavior, resulting in the victim's property losses, while the defendant there is intentional and illegal possession purpose, the facts of the crime are clear, the evidence is true and sufficient, constituting the crime of contract fraud. The defense argued that objectively, the defendant Yuan Sicheng did not commit fraud, and did not cause serious damage to the market economic order of the actual results, subjectively, the defendant does not have the intent to defraud, and no illegal possession purpose, the defendant does not constitute the crime of contract fraud. Prosecution and defense sides each issued a summary of the trial, the defendant made a final statement.

Finally, the presiding judge announced adjournment, the panel retired to deliberate.

 

In the commenting session, Ms. Xu Ying suggested that students should enhance the pre-trial instruction session, otherwise the court confrontation would appear to be ill-prepared. She emphasized the need to distinguish between facts and opinions, especially in the interrogation and questioning sessions. At the same time, the prosecution and defense need to have control over the rhythm of evidence, practice, if the other side of the presentation of evidence is incomplete, should be timely or separate presentation. The students benefited greatly from the guidance of the three judges, who combined the real trial scene and their own experience in handling cases.
