On July 11, 2023, the "Seminar on Criminal Defense Practice for Drug-Related Crimes in the Context of 'Fixing the Eleventh'" of King&Capital Food and Drug Law Research Center was successfully held in the Multi-functional Hall on the 22nd floor of Beijing King&Capital Law Firm, which was the second phase of Food and Drug Theme Sharing Activity organized by the Center.

In this seminar, Mr. Tang Jianbin, senior partner of Beijing King&Capital Law Firm and director of King&Capital Food and Drug Research Center, made a special sharing on "Competing Problems in the Crimes of Illegal Manufacture and Sale of Aspergillus Drugs", discussing and researching on the crimes that may be committed by illegal manufacture and sale of aspergillus drugs and the competing problems among several crimes after the addition of the crime of obstruction of drug administration in the Amendment to the Criminal Law (XI). On the occasion of illegal production and sale of narcotic drugs, the competing relationship, processing principles and defense ideas between the crime of obstructing the administration of drugs and the crimes of drug trafficking, illegal business operation, production, sale and supply of counterfeit drugs, production, sale and supply of substandard drugs, production and sale of substandard products, counterfeiting of registered trademarks, counterfeiting of patents, etc., provide a brand new theory and idea for the proper handling and resolution of the criminal defense of this kind of cases. The idea is to properly handle and solve the criminal defense problems of these cases.

Mr. Lv systematically analyzed the criminal composition of the crime of obstructing the administration of medicines from the perspectives of historical interpretation, textual interpretation and other perspectives, and quoted three classic cases to elucidate the criminal determination and defense method of the crime of obstructing the administration of medicines, which was added by the Amendment to the Criminal Law (XI). Mr. Zhang Sijia, Deputy Director of King&Capital Food and Drug Law Research Center, shared the topic of "Methods of defense in criminal cases involving drugs from the perspective of criminal integration". Afterwards, Mr. Zhang shared his research results on the criminal defense of drug crimes in three aspects, namely, knowledge, hazardous consequences, and cessation.

Mr. Wang Zhiqiang, Deputy Director of King&Capital Food and Drug Law Research Center, shared the topic of "Using the six-layer microscope model to build the defense idea of appraisal opinion on the crime of production and sale of counterfeit and substandard medicines", which put forward new breakthrough ideas and defense outlets for the criminal defense of drug crimes in a different way from the two layers of entity and procedure, and from the six dimensions of appraisal of samples, qualification, and process, evidence correlation, reappraisal, and defense countermeasures.
