From August 10th to 11th, 2023, Huairou District Judicial Bureau and Huairou District Lawyers Association organized the training for public lawyers and company lawyers in 2023, which was attended by more than 60 public lawyers and company lawyers in the whole district. Mr. Qin Qingfang, senior partner of King&Capital Law Firm, as a member of Huairou Science City High-end Public Interest Legal Service Group, was invited by Huairou Judicial Bureau to conduct a special legal training on "Forced Demolition of Illegal Construction".
Mr. Qin Qingfang explained the concept of illegal construction, the legal system of illegal construction, the identification of illegal construction and the mandatory demolition of illegal construction, and systematically sorted out the legal provisions on the mandatory demolition of illegal construction, with special emphasis on the procedural requirements for the identification and mandatory demolition of illegal construction.
Mr. Qin Qingfang not only introduced from the level of national laws and regulations, but also paid great attention to the practicality, combined with the latest local regulations such as "Certain Provisions of Beijing Municipality on Illegal Construction", "Beijing Municipal Commission of Planning and Natural Resources Administrative Law Enforcement Operation Procedures (for Trial Implementation)" and other latest local regulations, embodied the operation flow of the administrative law enforcement in the form of charts and diagrams, and also, by means of a large number of relevant jurisprudence of the Supreme People's Court and Beijing Municipal Courts of all levels. It also introduces the importance of lawful procedures of administrative behavior and the consequences of unlawful procedures in a vivid and detailed way, combining theory and practice in depth and hitting the key difficulties in the forced demolition of unlawful constructions.
Mr. Qin Qingfang's legal training was well received by the attorneys. In the exchange session, Mr. Qin Qingfang further discussed and exchanged ideas with the public lawyers and company lawyers present, and patiently answered the doubts raised by the lawyers. The lawyers expressed that the training built up a systematic and comprehensive knowledge system, clarified the division of responsibilities of different government departments in matters of forced demolition of illegal construction, and finally answered the long-standing confusion, and believed that the administrative law enforcement operation flowchart was detailed and specific, which was very helpful for carrying out the work.
