On September 27, 2024, the Criminal Department of King&Capital Law Firm ushered in the seventh installment of the series of lectures on “Criminal Case Thinking and Advocacy”, and the theme of this seminar was “New Issues and New Paths in Drug Crime Defense”.

This seminar was hosted by Yang Ye, a lawyer of King&Capital Law Firm, and Mr. Tang Jianbin, a senior partner of Beijing King&Capital Law Firm and the director of Kyoto Food and Drug Law Research Center, was the main speaker. The seminar in-depth analysis of new types of drug crimes defense skills, from the top ten types of defense views to dozens of new drug crimes defense logic and strategy to develop a comprehensive summary of new types of drug crimes defense, 90% of the seminar cases come from the Tang Jianbin lawyers personally handled the case, to bring the most direct, most practical experience sharing.

Yang Ye, a lawyer of King&Capital Law Firm, welcomed the attorneys and colleagues present and briefly introduced the professional background of Mr. Tang Jianbin and his outstanding achievements in the field of drug crime defense.

Mr. Tang Jianbin, Senior Partner of Beijing King&Capital Law Firm and Director of King&Capital Food and Drug Law Research Center, firstly analyzed the new situation of drug crimes, pointing out that in recent years, drug crimes have been characterized by a decline in quantity and the curbing of domestic drug production. He emphasized that the emergence of new types of drugs brought new challenges to lawyers in handling cases, especially in defense strategies and methods need to be updated and innovative.

During the discussion, Mr. Tang Jianbin introduced in detail the classification of drugs, including traditional drugs, synthetic drugs and new psychoactive substances. He suggested that the concept of new drugs can no longer be limited to chemical synthesis only, but should be categorized according to the popularity time and abuse of drugs.

Mr. Tang Jianbin particularly mentioned that the problem of abuse of new types of drugs is particularly prominent among the youth group and needs to attract great attention from all sectors of the society. By analyzing the typical cases released by the Supreme Court, he emphasized the difficulties and controversies in handling new types of drugs in legal practice.

In terms of defense strategy, Mr. Tang Jianbin shared his experience and insights. He proposed that for the defense of new drug crimes, lawyers need to pay attention to key issues such as drug conversion standards, purity conversion, and drug quantity determination. He also emphasized the importance of medical use and legality of drugs in the defense.

In addition, Mr. Tang Jianbin discussed the drug issues involved in cross-border e-commerce and the legal use and abuse of narcotic drugs, and provided his insights and suggestions.
