On March 14th, the third lecture of the Criminal Defense Lecture Hall of China University of Political Science and Law, sponsored by the School of Criminal Justice of China University of Political Science and Law and the Research Center for Innovation and Development of Criminal Defense of China University of Political Science and Law, was successfully held in the Teaching and Book Complex Building of College Road Campus.
The lecture was given by Dr. Liu Lijie, a doctor of criminal law from China University of Political Science and Law, and a senior partner of Beijing King&Capital Law Firm who is in charge of the second department of criminal business, and was presided over by Prof. Zhao Tianhong of the School of Criminal Justice of China University of Political Science and Law. Prof. Yin Bo, Prof. Bai Rufeng, Associate Prof. Xie Shu and Mr. Xu Yongwei from China University of Political Science and Law and other experts and scholars attended the lecture. The lecture received wide attention and active participation from teachers and students both inside and outside the university and practitioners outside the university, with about 200 people attending.
At the beginning of the lecture, Prof. Zhao Tianhong introduced the rich experience of Mr. Liu Lijie in the field of criminal court and criminal defense lawyers, as well as the series of professional articles and monographs published by Mr. Liu Lijie in the field of criminal defense, and warmly welcomed all the participants to the lecture.
Zhao Tianhong
The keynote speaker, Mr. Liu Lijie, shared the topic of “Criminal Defense Field”. At the beginning of the lecture, Liu Lijie took the etymology of the word “field” as the starting point and pointed out that a field refers to the scope, type or department of a specialized activity or undertaking, while the field of criminal defense mainly refers to the scope and professional subdivision of criminal defense. Criminal defense can be subdivided into different professional fields under different classification criteria such as intuition, industry characteristics, party identity, trial procedures and class crimes. In the form of a set of diagrams, Mr. Liu pointed out that there may be a certain degree of crossover in the field of criminal defense under different classifications, and that the mixed field is also the key point of criminal defense. Subsequently, Mr. Liu combined with the rape cases, intentional homicide cases, DNA misidentification cases, embezzlement, bribery, illegal loan cases, insider trading, securities market manipulation cases, as well as black cases and other cases of more than ten practice cases, violent crimes, economic crimes and mixed crimes and other crimes of the criminal defense field of the characteristics of the generalization of the summary. Mr. Liu also took the three extended areas of criminal defense such as criminal-civilian intersection, criminal compliance and criminal accusation as examples, and through the analysis of litigation visualization, he made a detailed deduction of the relevant cases, which brought a vivid practical training class showing the depth and breadth of thinking of criminal defense lawyers to the students on the spot.
In addition, Mr. Liu encouraged students who aspire to be lawyers to consolidate their foundation in criminal law, criminology, logic and other disciplines based on their personal interests, market-driven, path-dependent, and natural evolution perspectives, to strengthen their professional training in various litigation fields, to be able to transfer their industry knowledge, practical experience and abilities, and to realize a high level of competence in economics, psychology, sociology and other fields, so as to choose the most suitable lawyers for their career in criminal defense. In order to achieve a high level of understanding in various fields such as economics, psychology, sociology, etc., the firm chooses a suitable field of defense for itself and has the courage to break through the limitations of a certain field of defense when the conditions and time are ripe and to climb to a higher peak of defense.
Liu Lijie
Prof. Wang Jinxi pointed out that Mr. Liu's speech embodied “the quality of justice has depth”. Citing the Simpson trial of the century as an example, Prof. Wang pointed out that a lawyer's professional knowledge determines the quality of defense in achieving justice. At the time of Simpson's acquittal, he was already penniless due to the payment of high attorney's fees, which objectively reflects that justice can be measured by economic value to a large extent. On the one hand, the breakdown of the field of endless, lawyers with professional knowledge, has the ability to provide in-depth services for effective defense is very important, criminal wrongdoing in addition to some of the case handling organs wrong handling, more closely related to the parties to hire the ability of the defense lawyers; on the other hand, lawyers rely on the essence of the market-driven case, to be squarely on the basis of lawyers' commerciality, a rational view of law firms on the basis of the commercialization of the scale of the commercial management.
Wang Jinxi
The talker Sun Guangzhi lawyer combined with his nearly seventeen years of experience in handling cases pointed out that the cognitive order of criminal defense lawyers in the process of handling cases is often the first to see the evidence, then to see the people, and finally to see the human nature. Carefully review the evidence, properly deal with the relationship between all parties in the case depends on the success or failure of the defense. Mr. Sun also combined with the field of defense lawyers should have the qualities of the lawyer. Sun lawyers think, lawyers in handling “natural crime” case (infringement of personal rights, property rights crime case) is the main consideration of the case of factual understanding of the ability to rely heavily on the mastery of the rules of thumb and the use of; for economic crimes, crimes at work when the main consideration is the legal evaluation of the fact that not only the legal evaluation of ability. Need solid, comprehensive legal knowledge, but also need to have strong logical thinking, dialectical thinking ability; and “black”, “evil” case defense is a test of the lawyer's brain power, physical strength and other levels of comprehensive ability.
Sun Guangzhi
The talker Xia Jun lawyer combined with Liu lawyers lecture, further summarized the current criminal defense field highlights three new trends: First, financial crime, economic crime is a high incidence of trend, especially the number of cases of crowd economic crime is growing rapidly; Second, with the promotion of the system of criminal compliance and not prosecuted, and further broaden the defense of the criminal defense lawyer's ideas and business areas, whether it is ex ante compliance or ex post compliance, criminal lawyer Are playing an indispensable role; Third, a large number of criminal and civil cross-complex cases emerge, the criminal lawyer's professionalism and practice level put forward higher requirements. These new trends are both challenges and opportunities for criminal lawyers. Mr. Xia also talked about his feelings around the defense in the field of crowd-related economic crimes, combined with his experience in handling cases, because such cases often involve new types of issues such as cybercrime, blockchain, digital currencies, network payments, etc., and the forms of evidence are mostly in the form of electronic data, which need to be highly valued.
Xia Jun
Lawyer Weng Xiaoping, the interviewer, pointed out that criminal practice is called the bright pearl in the crown of lawyers' practice not only because it involves basic rights such as personal freedom, life, and property, but also due to the complexity and difficulty of criminal defense, and that successful defense can bring a great sense of achievement. Although lawyers, as a legal service industry, also have certain commercial factors, there are also principles and bottom lines that we should adhere to. For students who aspire to a career in criminal defense, the first thing they should establish is the principle of responsibility, responsible to the client and responsible to the law. At the same time, they should also master basic legal knowledge, improve their research ability and investigation and evidence collection ability, and develop a professional defense style with solid evidence literacy.
