Recently, Mr. Xu Ming of King&Capital Law Firm was invited to give a lecture in the “Learning Lecture Hall” of the headquarters of Aviation Industry Corporation of China (hereinafter referred to as “Aviation Industry”). Mr. Xu Ming gave a lecture on the topic of “Key points of criminal risks related to production safety, state secrets and securities and suggestions for prevention”, using cases to explain the law and explaining in depth the criminal risks and prevention and control methods of production safety, state secrets and securities. The lecture hall was held in the form of “on-site + video” meeting, with the main venue located at the headquarters of Aviation Industry, and 11 video sessions set up, and a total of 197 people participated in the study in the main and session venues.

In terms of safety production, Mr. Xu Ming started from the cases of Lvliang fire, CCTV building fire, Tianjin port explosion, Fushun high-speed railroad project fire, etc., and sorted out the crime system of safety production, highlighting the four major features of this type of crime: strict criminal law network, front-loading of criminal penalties, wide range of responsible subjects, and stringent criminal policy, and explained the different types of responsibility and causation adjudication rules for the senior leaders, supervisory leaders, and front-line employees. Mr. Xu Ming explained the different types of liability and causation rules for senior leaders, supervisors and frontline employees. In terms of state secrets, Mr. Xu Ming pointed out the risk points that are easy to be ignored in practice in view of the attributes of the military industry in the aviation industry, and reminded aviation personnel to enhance their awareness of confidentiality. In terms of securities crimes, Mr. Xu Ming introduced the case study, focused on insider trading and disclosure of insider information, and explained in detail the criminal policy of “zero tolerance” for securities crimes, the presumption rule of insider trading, and the construction of compliance system. The three-hour course was full of content, vivid cases and interesting explanations, and was highly evaluated by the leaders of the Group, who thought that the course was of great guiding significance to enhance the risk prevention and control awareness of the personnel in the aviation industry.
