On the evening of May 9, 2024, the Student Union of the School of Criminal Justice of China University of Political Science and Law successfully held the “King&Capital Three Talks” seminar in Staircase Classroom I. Associate Professor Zhu Guangxing from the School of Criminal Justice of China University of Political Science and Law, Lawyer Xu Wei, partner of Beijing King&Capital Law Firm, and Prosecutor Lu Ying, assistant of Beijing Changping District People's Procuratorate attended the lecture.
Before the official start of the activity, the Outreach Department of the School of Criminal Justice of China University of Political Science and Law expressed a warm welcome to the guests and teachers, and introduced the guests and the background of the activity.
Afterwards, the three guests expressed their opinions on the issue of “the aging and malignancy of bullying in schools”.
First of all, Associate Professor Zhu Guangxing started with the “Program on Strengthening Comprehensive Management of Bullying among Primary and Middle School Students” issued by the Ministry of Education and other 11 departments in 2017, explained the concept of bullying in schools for minors in detail, defined the relationship between bullying and juvenile delinquency, and pointed out the current judicial dilemma of bullying in schools. Then, Associate Professor Zhu Guangxing expressed his views on the downward adjustment of the age of criminal responsibility, especially emphasizing the principle of education-based, punishment-supplementary and two-way protection policy for juvenile delinquency. Associate Professor Zhu Guangxing proposed measures to prevent and solve school bullying from the perspectives of society, family and school.
With years of experience in prosecutorial affairs, Assistant Prosecutor Lu Ying introduced the current work of criminal prosecution of minor school bullying in light of the White Paper on Prosecution of Minors issued by the Supreme Prosecutor's Office in 2023. Then, Assistant Prosecutor Lu Ying put forward six major protections - school, family, society, network, government and judicial protection - and made a specific analysis of the reasons for the underage and malignant nature of school bullying, and put forward the attitudes of the procuratorial authorities towards juvenile violent crimes from the procuratorial perspective - -Discipline and precise help and education in accordance with the law, as well as sanctions and penalties and corrective measures of graded disposition of the disposition. Ms. Lu Ying, assistant prosecutor, combined with her own experience and put forward measures to prevent bullying in schools.
Combining his own experience, Mr. Xu Wei suggested that minors' understanding of the concept of bullying in schools is very vague, and combined with two cases of vicious bullying in schools, he illustrated that there are certain difficulties for victims to protect their rights at present. Then, Mr. Xu Wei proposed a solution from the perspective of the victim's rights - to seek help from legal professionals, to learn more about the school's channels of reflection, and how to collect evidence.
After the lecture session, the seminar entered into a guest discussion session on the topic. The three guests expressed their views, discussing the solutions to the underage and viciousness of school bullying from the perspective of the intersection of disciplines in multiple fields.
The third part of the lecture was a question-and-answer session, in which the guests gave objective and detailed answers to the questions raised by the students.
Finally, the host made a brief summary of the lecture, pointing out the positive effect of this lecture on the cultivation of legal thinking, and expressed his sincere thanks to the guests and the audience. At this point, the King&Capital Three Talks Lecture came to a successful end.
