On June 7, 2024, King&Capital Law Firm attorneys Xu Ying and Weng Xiaoping were invited to do the training of “Criminal Legal Risks and Prevention of Safety Production” for the listed company King&Capital Development Co.
The field of real estate development and construction, in which Jingtou Development is located, is a field with high incidence of production safety liability accidents, and is also a field to which the Party and the State attach great importance. Since the 18th National Congress of the Party, the construction of the rule of law on production safety has been significantly accelerated. Amendments to the Work Safety Law and the Fire Services Law, the formulation of emergency regulations on work safety accidents, the “two high courts” issued an interpretation of several issues concerning the application of law in handling criminal cases of endangering work safety, and the “Eleventh Amendment to the Criminal Law” has brought the real danger of behavior into the scope of criminal law, so that the legal net of work safety is becoming more and more stringent. Article 28 of the Work Safety Law also makes it clear that production and management units should provide work safety education and training to employees, and should establish work safety education and training files. Production safety education and training has become an important indicator for assessing the conditions of production safety of enterprises.
In this context, it is of great significance for BJI Development to conduct training on the theme of “Criminal Legal Risks and Prevention of Work Safety” with the goal of “Protecting Yourself, Protecting Your Family, and Ensuring Safe Production”.
After the preliminary research, we found that real estate development enterprises are not the direct construction parties, and generally perform procedural matters such as review, approval, contracting, supervision, etc. in production and operation, and are generally not the direct perpetrators of safety accidents, so they are easy to ignore their own criminal legal risks, and relax their vigilance in production and operation activities. Therefore, in this training, the two lawyers targeted the position and role of real estate development enterprises in the construction process, the duties and positioning of the relevant responsible personnel, and the boundaries of responsibility with the construction side, supervision side, design side, survey side and other parties, and other issues, targeted training.
