On the afternoon of July 13, 2024, a preparatory meeting for the preparation of standards for calculating the cost of claims for stoppage of work in construction projects organized by the Legal Service and Dispute Mediation Working Committee of the China Construction Association (hereinafter referred to as LAC) was held in the conference room of the Teaching Building of the Xicheng Campus of the Beijing University of Architecture, with Chen Taixiang, Executive Vice President and Secretary General of LAC, and the vice presidents attending the meeting. The meeting was presided over by Vice President Tan Jinghui, and members of the expert group traveled to Beijing from all over the country to attend the meeting. Mr. Wang Chunjun, member of the management committee and senior partner of King&Capital Law Firm, was invited to participate.



At the beginning of the meeting, Mr. Chen Taixiang made a speech, introduced the common phenomenon of stoppage of work in the construction field and its impact, elaborated on the background of the standard preparation, and proposed that this group standard is of positive significance in filling the gap of the guideline and helping the society to settle disputes and stop disputes.

The meeting listened to the experience report of Henan Provincial Construction Industry Association, and He Haiwang, Deputy Secretary General of the Legal Committee, shared the preparation process and difficulties of local standards. Then representatives of cost consulting companies, project management companies, construction enterprises, construction companies, law firms and other units spoke in turn and exchanged views on the issue of cost claims arising from stoppage of work. The experts expressed their views on the important and difficult issues of preparation from the perspectives of project management, cost technology and legal profession, and the discussion mainly focused on the official name of the standard, definition of terms, scope of claims, content focus and role positioning. The moderator, Tan Jinghui, summarized the speeches of the experts and clarified the objective of the preparation again, aiming at providing reference standards for the special matter of cost calculation under abnormal construction condition of construction projects and further clarifying the working idea. Finally, Jiang Jun, Director of Engineering Law Research Institute of Beijing Architecture University, thanked the experts for their positive speeches, affirmed the important role of this standard for judicial adjudication and performance of construction works, and wished the subsequent preparation work to be carried out smoothly.

In recent years, due to the national environmental protection policy and the impact of catastrophic weather and other factors, construction projects in the construction process often have a certain degree of stoppage of nesting, which results in a significant increase in construction costs, but the determination of the costs borne by the lack of uniform standards. The standard for calculating the cost of stoppage and harboring of work led by the Committee is a positive response to this realistic demand, with the intention of providing a reference basis for the construction industry, filling the normative gaps of the difficult problems of stoppage and harboring of work, and promoting the balance and protection of the interests of the construction unit and the construction unit and other related parties. This preparatory meeting is of great significance in gathering the strength of the industry in the field of construction, clarifying the idea of preparation, forming a scientific decision, widely promoting the advice of experts in various specialties, and also indicating a specific direction for the next official start of the preparation of the standard for calculating the cost of claims for stoppage of work in construction projects.
