On the afternoon of July 27, 2024, the Marriage and Family Affairs and Wealth Management Inheritance Legal Affairs Center and Kyoto Family Trust Legal Affairs Center Dalian Branch, jointly organized by Beijing King&Capital Law Firm (hereinafter referred to as “Kyoto Law Firm”) and Beijing King&Capital Law Firm (Dalian) Law Firm (hereinafter referred to as “Kyoto Law Firm Dalian”), was successfully held in the large conference room of the Dalian Branch. The third sharing guest is Prof. Gao Huiyun, senior partner of Beijing King&Capital Law Firm. Prof. Gao Huiyun is the executive director of Beijing King&Capital Family Trust Legal Affairs Center, and the senior consultant of Beijing King&Capital Law Firm in tax law. She holds the title of professor of tax law and has visited and further studied in Australia, Singapore, Germany and the United Kingdom. She is well versed in both domestic and international tax law and provides tax and related legal support for private banks, trust and investment companies and various funds in mergers and acquisitions, IPOs, and financing, as well as international tax support for enterprises in offshore financial structures, and strategic tax planning and identity planning at home and abroad for individual family trust clients. Prof. Gao Huiyun brought the topic of “Family Property Protection and Application of Family Trust in the Context of New Company Law” to the audience. From the perspective of “limited liability”, Prof. Gao discussed the relationship between shareholders' liability and personal property, and from the perspective of “family enterprise connection”, he examined the connection between corporate debt and family property: through representative practical cases, he analyzed in depth the possible implication of corporate debt on family property. Through representative actual cases, it analyzes in-depth the various situations in which corporate debts may have an impact on family properties. Exploring the protection of family equity assets from the perspective of “family trusts”: through specific cases, he launched an in-depth discussion and analyzed the important role played by family trusts in the protection of family property. At the same time, Prof. Gao also comprehensively introduced the many other functions of family trusts, such as corporate tax saving, providing basic livelihood security, and playing the role of birth encouragement, etc. In addition, he also mentioned the role of family trusts in protecting family assets.
