On 9 January 2025, a delegation from King&Capital's Criminal and Employment Departments visited the Faculty of Law of the National University of Singapore (NUS) for a unique exchange of views on criminal law between China and Singapore with Professor Alan Tan.
The seminar was conducted by Professor Alan Tan of NUS Law School, who was born in Malaysia, graduated from NUS with a Bachelor's degree, obtained his Master's and PhD degrees from Yale University, and is currently serving as a Global Visiting Professor at New York University School of Law. He is also a Global Visiting Professor at New York University School of Law. He brings a wealth of knowledge and insights to the exchange programme.
Taking several typical cases of intentional homicide, intentional assault and drug offences, which have great influence and controversy in Singapore, as examples, Professor Tan raised some difficult issues in Singapore's criminal justice practice, focusing on the elements of criminal conduct, causation, strict liability, defences, battered woman syndrome, etc., and had a lively discussion with the King&Capital lawyers.
The King&Capital lawyers actively participated in the discussion and discussed the differences and similarities between the criminal laws of Singapore and China in terms of the determination of ‘intent’ in the offence of intentional homicide, the sentencing circumstances of the offence of intentional homicide, the application of the law to drug offences, and the battered woman syndrome, amongst other related issues.
Through this exchange, the King&Capital lawyers not only gained a more intuitive and in-depth understanding of Singapore's criminal legal system, but also gained a deeper understanding of the similarities and differences between the Chinese and Singaporean criminal legal systems. This exchange also laid the foundation for further academic exchanges between King&Capital and NUS in the future.
