"Cross-jurisdictional Wealth Preservation and Inheritance Roundtable" Successfully Held

On March 7, 2025, Beijing Kyoto Law Firm held the first roundtable forum of the 30th anniversary training series - "Cross-Jurisdictional Wealth Preservation and Inheritance Roundtable". Taking the recent hot events as an entry point, Kyoto Family Trust Legal Affairs Center invited industry experts in the fields of law, tax and trust to gather together to discuss in-depth the asset preservation and inheritance strategies of HNWIs in the context of globalization around the core issues of tax planning, cross-border marriage and offshore trust, so as to provide professional insights and solutions for the sound management of wealth and intergenerational inheritance.

 

 

 

At the beginning of the event, Mr. Wei Dongda took the recent hot events as the starting point and made a thematic sharing on "Introduction to the Legal Provisions Related to Inheritance in China's Taiwan Region", which introduced the background foundation for the subsequent seminars.

 

 

 

 

 

Subsequently, the roundtable discussion centered on the theme of "Overseas Estate Tax and Inheritance Maintenance", in which Mr. Zhang Yanfei and Mr. Wang Shuaifeng of Kyoto Law Firm, as well as Mr. Ni Ling, Director of Operations, China, and Mr. Ke Songxian, Regional Director of Legal and Operations of Camasus Group, had in-depth discussions, with Mr. Wei Dongda acting as the moderator of the roundtable discussion.

 

 

 

 

 

Mr. Wang Shuafeng focused on the impact of overseas estate tax on cross-border property inheritance and provided wealth planning advice to HNW families. Mr. Wang suggested avoiding placing property in countries or regions with inheritance tax, reasonably planning the tax status of family members, and isolating tax risks through tools such as insurance and trusts.

 

 

 

 

 

Mr. Zhang Yanfei focused on the issue of custody in cross-border marriages between Taiwan and mainland China, discussing three main areas: legal jurisdiction, judgment enforcement and law application. Mr. Zhang analyzed where the court has jurisdiction, how the judgments of the two courts are enforced, as well as the similarities and differences in the legal provisions on custody and guardianship between mainland China and Taiwan, emphasizing the principle of the best interest of the children.

 

 

 

 

 

Mr. Ni Ling shared his views on the legal functions and beneficiary arrangements of family trusts. He emphasized the importance of designating beneficiaries and distribution conditions through the trust will letter and pointed out that HNWIs should set up overseas family trusts as early as possible to avoid risks such as debts, litigations and disputes over property ownership. Mr. Ni Ling suggested that the trust should be set up before the settlor has full civil capacity, the family relationship is stable and the risk has not occurred.

 

 

 

 

 

Mr. Ke Songxian introduced the basic concept of offshore trust and its characteristics in different jurisdictions, such as Wyoming of the United States, British Virgin Islands and Singapore. He fully introduced the major uses of trusts in asset protection, tax planning and children's estate management, and demonstrated the practical applications of trusts in avoiding high taxes and protecting assets through real cases.

 

 

 

 

 

After the roundtable forum, Mr. Ni Ling made a keynote sharing on "Offshore Trust Building Practice", focusing on the wealth risks faced by HNW clients, the basic structure of family trust and its advantages. He demonstrated the practical application of trusts in asset protection, tax planning and wealth inheritance through the case of BVI VISTA trust structure, the case of foreigner entrusted trusts and the case of trusts for U.S. tax residents.
