Alxa SEE North China Project Center Goes to King&Capital to Exchange Entrepreneurs' Criminal Risk Prevention and Control and Compliance Management

On March 20, Alashan SEE North China Project Center and King&Capital Law Firm jointly held a seminar with the theme of “Entrepreneurs' Criminal Risk Prevention and Compliance Development”. The event focused on the criminal legal risks faced by private enterprises in their operations, and conducted in-depth discussions on the hot issues in the compliance construction and judicial practice of private enterprises. A number of entrepreneurs and representatives of public welfare organizations from Alashan SEE North China Project Center participated in the meeting, which was hosted by Zhang Le, Vice Chairman and Secretary General of the 6th Work Committee of Alashan SEE North China Project Center.


Chu Changzhi

Mr. Chu Changzhi, Managing Partner and CEO of King&Capital Law Firm, delivered a speech on behalf of the firm. First of all, he reviewed the development history of King&Capital Law Firm for 30 years, and introduced the achievements of King&Capital Law Firm in the areas of professional development, social responsibility practice, and public welfare services. Su Yong, Chairman of the Sixth Work Committee of Alashan SEE North China Project Center, made a brief introduction on behalf of Alashan SEE North China Project Center. As a highly influential public welfare platform in North China, Alashan SEE North China Project Center gathers more than 90 entrepreneurs who are committed to social responsibility, focusing on the core areas of biodiversity conservation, public environmental education and sustainable brand cooperation. He hoped that through this event, the two sides could deepen their collaboration and explore the “dual-track” model in the field of legal empowerment and public welfare innovation, so that enterprises could build a lifeline of compliance and development while guarding green water and green mountains.

The theme sharing session was hosted by Ms. Zhu Yalin, Senior Partner of King&Capital Law Firm, and senior partners of King&Capital Law Firm, Ms. Liang Yali, Mr. Zhang Qiming, and Mr. Zang Desheng, respectively, shared their views from the perspectives of policy trends, case analysis, and practical advice.


Ms. Liang Yali

Senior partner of King&Capital Law Firm, Director of King&Capital Criminal Defense Research Center, Ms. Liang Yali, started with the topic of “Criminal Risks of Entrepreneurs and Emergency Handling”, and interpreted from the latest policy trend of private enterprise protection, from the three aspects of the main theme of strict control and generous supervision, special actions in various fields, and the legislation for crimes within enterprises. She said that private enterprises should take the initiative to pay attention to such winds and make clear the dialectical relationship between “strict supervision” and “protection of rights and interests”; enterprises should raise their risk awareness, establish a risk prevention and control system, and analyze the characteristics of risks in key areas on a regular basis; and enterprises and law firms should closely communicate with each other to share crisis response strategies and improve their emergency response strategies. Share the crisis response strategy, enhance the enterprise's emergency response ability. Based on her cases, Ms. Liang Yali shared her views on the defense of criminal cases for entrepreneurs from three aspects: two-dimensional thinking of defense work, specialized and effective defense, and protection of rights and interests in property disposal. Finally, she said that to guarantee the legal and compliant operation of enterprises and to protect the healthy and compliant development of enterprises requires the joint efforts of professionals from various parties.


Zhang Qiming

Mr. Zhang Qiming, Senior Partner of King&Capital Law Firm, analyzed the struggles of entrepreneurs between the accumulation of wealth and legal boundaries through the vivid and graphic cases of “Lao Li Case”, “Lao Huang Case” and “Lao Guo Case”, revealing the criminal risk of entrepreneurs and their struggles with legal boundaries. Jacqueline Zhu

Based on judicial practice, Ms. Zhu Yalin, Senior Partner of King&Capital Law Firm, systematically analyzed three typical patterns of “criminalization of people”, and combined with data and specific cases, revealed the devastating impact of criminal risks on enterprises and entrepreneurs. Facing the “three lines of defense” for risk prevention and control, Zhu Yalin suggested that entrepreneurs should do a good job in preventing beforehand, responding during the incident and repairing afterward. She emphasized that “entrepreneurs should strengthen the awareness of criminal risk, and lawyers should enhance the ability of criminal-civil cross-business.” Through multi-party collaboration, to promote the construction of a benign business environment under the rule of law, and truly protect the entrepreneurial community.


Zang Desheng

Mr. Zang Desheng, senior partner of King&Capital Law Firm, focused on the analysis of the phenomenon of “criminalization of debt” and “criminalization of the people”, in which the boundaries between economic disputes and criminal offenses are grasped. Combined with the specific case practice, Mr. Zang Desheng talked about how the private entrepreneurs can utilize the criminal means to safeguard their own rights and interests and prevent the risk of being held criminally liable. On the one hand, for economic disputes with others, the other party is indeed suspected of criminal offenses, to use the full law, but can not forge evidence or fabricate facts, otherwise there is a risk of false accusations; on the other hand, in the process of business, to grasp the boundaries, adhere to the legal bottom line, do not give people the power to guard against the risk of criminal law.
