On the morning of May 18th, the book launch of “The Dao and Technique of Procedural Defense” was held in Beijing by Dacheng Law Offices and Law Publishing House Law & Business Branch, and co-sponsored by King&Capital Law Offices and other law firms, and a seminar on procedural defense was also held on the spot. Mr. Zhu Yonghui, Director of King&Capital Law Firm, attended the event and delivered a keynote speech.
The seminar was addressed by Yuan Huazhi, Director and Chairman of the Board of Directors of Dacheng Law Offices, Li Dajin, Chairman of the Partners' Meeting of Investec Republican Law Firm, and Zhao Mingxia, Senior Planning Editor of the Law Publishing House's Law and Business Branch. The event brought together many academic authorities and practical elites to discuss in depth the practical experience and theoretical essence of procedural defense, in order to enhance the overall quality and efficiency of criminal defense, promote the concern and attention to procedural justice, and inject new momentum into the construction of the rule of law.
Procedural defense is an important part of criminal defense, complementary to the substantive defense, which includes the defense of jurisdiction and avoidance, the defense of coercive measures and the necessity of detention, the defense of the legitimacy of the means and procedures of evidence collection, and the defense of the illegality of the trial procedures. Procedural defense not only guards the dignity of procedural rule of law with independent value, but also provides strong support for the realization of the goal of substantive defense, and jointly safeguards the legitimate rights and interests of the parties.
In the expert lecture, Professor Gu Yongzhong of China University of Political Science and Law analyzed the theoretical positioning and practical logic of procedural defense.
In the theme sharing session, Mr. Zhu Yonghui, director and senior partner of Beijing King&Capital Law Firm, combined with his own experience in handling cases, pointed out that the current procedural defense is still facing the reality of lagging judicial concepts, lack of legal norms and other dilemmas. He used actual cases to illustrate that even after the approval of the arrest can still be reviewed through the necessity of detention and other procedures to actively fight for the rights and interests of the parties, emphasizing that the criminal defense lawyers should have the courage to explore, adhere to the practice of procedural defense. Zhu Yonghui highly praised Lou Qiuqin's new book “procedural defense of the road and the art of” the important contribution to the practice of criminal defense, praised Lou Qiuqin is not only a procedural defense practitioner, but also the theoretical system of the constructor.
He believes that the book contains more than 150 typical cases, not only for peers to provide practical reference, but also promote the rule of law process of procedural defense.
Finally, Zhu Yonghui called on the legal profession to join hands to promote procedural justice and the improvement and development of the criminal defense system.
The book launch and seminar of “The Dao and Technique of Procedural Defense” came to a successful end in a warm academic atmosphere and practical discourse. Taking procedural defense as the starting point, the event linked up the in-depth deconstruction of the theoretical community, the extraction of experience from the practical community, and the transmission of value from the publishing community, not only dedicating a professional book with both ideological weight and operational temperature to the field of criminal defense, but also setting up a platform for dialogue on the concept of procedural justice within the legal community.
