On May 25, 2025, the “Third Dalian Arbitration Week Sub-Forum - Criminal-Civil Intersection of Arbitration Cases” was successfully held at the Holiday Inn Dalian Xinghai Hotel, hosted by the Dalian Arbitration Commission/Dalian International Arbitration Court (hereinafter referred to as the “Dalian Arbitration Commission”) and organized by the Beijing King&Capital Law Firm. -Criminal-Civilian Intersection of Arbitration Cases” was successfully held at the Holiday Inn Dalian Xinghai. The forum invited famous experts and scholars from Dalian Lawyers Association, Dalian Lawyers Association, Northeast University of Finance and Economics, Dalian Maritime University and Dalian Ocean University to attend, gathering many experts and practical elites in the legal field, aiming at discussing the hotspots and difficulties in the field of cross-cutting issues of criminal and civil matters, and providing new ideas for the arbitration practice and theoretical research.
Guest Speaker: Xia Cuiping
At the opening ceremony of the forum, Ms. Xia Cuiping, full-time vice president of Dazhong, firstly delivered an opening speech. She pointed out that the flexibility and efficiency of arbitration is an important way to solve economic disputes, and its fairness, efficiency and professionalism are well recognized by all walks of life. However, against the background of rapid economic development, the criminal-civilian crossover problem in arbitration cases is becoming more and more prominent, and this phenomenon has brought a lot of new challenges to arbitration practice. Xia Cuiping said that Dazhong has always been committed to strengthening the theoretical research and practical exploration of arbitration, and facing up to the difficulties of disputes arising from criminal-civilian cross-problems in arbitration hearings, and hoped that the in-depth discussions and exchanges in this forum can bring together the wisdom and strength of all parties, build consensus, and build a legal ecology of collaborative governance, so as to promote the research and resolution of criminal-civilian cross-problems in arbitration cases.

Mr. Hua Yang, Director of Beijing King&Capital (Dalian) Law Firm, introduced the background of the preparation of this forum in his speech, and elaborated how to balance the public power of combating crime with respecting and protecting the private rights of the parties in civil and commercial arbitration is an important topic of criminal-civilian cross-cutting issues in arbitration procedures. At the forum, Lin Leming, Associate Professor of Law School of Dalian Maritime University, and Zhao Qilong, Zhang Qiming and Peng Jiyue, Senior Partners of Beijing King&Capital Law Firm, delivered keynote speeches respectively. They started from the underlying logic of criminal-civilian crossover issues, introduced the core disputes and response strategies of the two types of criminal-civilian crossover cases: competing and implicated, analyzed in depth the essential differences and substantive impacts of criminal-civilian crossover business in arbitration and civil litigation proceedings, and analyzed in detail the defense strategies and treatment ideas of criminal-civilian crossover issues in civil and commercial activities with the practical cases of wagering agreement and shareholders' loan.

With the topic of “Analysis of Criminal-Civilian Intersection Cases of Betting Contracts”, Zhang Qiming analyzed in detail the determination of civil and commercial validity of betting agreements and criminal risks, and proposed defense strategies such as focusing on important matters of the transaction and assessing the valuation of the consensual and other matters through practical case studies.

Peng Jiyue took the topic of “From Civil Legitimacy to Criminal Arrogance and Recourse: Risk Crossing of Shareholders' Borrowing Behavior”, judging the boundary between criminal and civil needs to be examined from subjective and objective dimensions, and even if there are appearance defects in the borrowing and lending behaviors, it should be given priority to deal with them through civil legal rules to avoid over-criminalization.
Guests at the conference engaged in heated discussions and brilliant speeches on hot issues such as principles of handling criminal-civil cross issues in arbitration proceedings, enforcement procedures, and ways of conflict resolution, which triggered strong resonance and profound thinking among the audience.
