Mr. Sun Guangzhi, member of Compliance and Risk Prevention and Control Law Committee of Beijing Municipal Lawyers' Association and senior partner of King&Capital Law Firm, made a speech on "Criminal Defense and Risk Prevention and Control of Criminal Cases Involving Enterprises--Analyzing the Implications of Amendment XII of the Criminal Law for the Prevention and Control of Criminal Law Risks of Enterprises. Mr. Sun Guangzhi systematically elaborated on three aspects: firstly, criminal defense and risk prevention and control of enterprise-related criminal cases; secondly, experience sharing of illegal public deposit absorption cases; and thirdly, thoughts and insights on the new rules of the Criminal Law Amendment (XII) on enterprise-related crimes.
He first analyzed the causes of enterprise criminal legal risk and its possible harmful consequences, and emphasized that “once an enterprise-related criminal case occurs, the enterprise is already at risk, and the enterprise and the relevant responsible persons will face a series of investigative measures by the case-handling authorities.” When analyzing the causes and defense objectives of enterprise-related criminal cases, Mr. Sun Guangzhi, combined with typical cases and charts, gave an in-depth explanation from the perspectives of the constituent elements of unit crimes, conviction defense and sentencing defense, etc. Finally, he gave a speech on the Amendments to the Criminal Law (Amendment) Act, the Criminal Law (Amendment) Act and the Criminal Law (Amendment) Act. Finally, he shared his personal thoughts and practical insights on the key crimes involved in the Amendment (XII) to the Criminal Law, such as the crime of illegally operating a similar business, the crime of illegally making profits for relatives and friends, and the crime of discounting shares at a low price and selling state-owned assets for favoritism, in the hope that it would bring enlightenment to the colleagues attending the meeting.
Li Xianghui
Li Xianghui, Director of Compliance and Risk Prevention and Control Law Committee of Beijing Lawyers Association, made a concluding speech.
