“2011 Report Conference of Chinese Entrepreneurs’ Crimes" and the "First Seminar on Prevention and Control of Criminal Legal Risks” Co-sponsored by King and Capital Held in Beijing

On January 15, 2012, the “2011 Report Conference of Chinese Entrepreneurs’ Crimes" and the "First Seminar on Prevention and Control of Criminal Legal Risks” organized by the “Legal Daily,” sponsored by the “Legal Person Journal” and co-sponsored by King and Capital was held in Beijing.

 

The seminar released the "2011 Report on Chinese Entrepreneurs’ Crimes." The authors of the report have collected accounts of 220 entrepreneurs involved in criminal offenses reported by the media in 2011, including directors or persons in charge of enterprises who have taken advantage of the enterprises to commit crimes, and advanced conclusions on the situation of suspected crimes of entrepreneurs in 2011.

 

Tian Wenchang, Director of King and Capital, made a keynote speech on the analysis of entrepreneurs’ crimes. In his speech, Tian Wenchang categorized four classes of entrepreneurs’ crimes. First, the entrepreneurs involved committed a criminal offense knowingly; second, they committed criminal offenses unknowingly; third, the they committed criminal offenses resulting from unclear laws and regulations; fourth, the entrepreneurs were victims of trumped up charges. Tian Wenchang analysed each of the four classes and cautioned entrepreneurs that the current legal environment was highly risky. Entrepreneurs of state-owned corporations and private-owned corporations were both players in a fair market, and detailed rules should be brought forward by legislation, so as to create just judicial circumstances for both kinds of entrepreneurs.

 

Zhu Yonghui, partner of King and Capital, released other parts of the Report. He collected data about cases involving economic crime King and Capital had handled since 2000 and analysed some problems.

 

Wang Jiuchuan and Yang Zhaodong, partners of King and Capital, also made speeches at the seminar.

 

As a legal service team, King and Capital, has increasingly focused on entrepreneurs’ crimes and dealt with many cases attracting vast social attention including the funding fraud case of Wu Ying which is still proceeding, the insider trading case of Huang Guangyu, former Chairman of Gome, the contract fraud case of Yan Liyan and the abuse of power of Zhao Xin. What’s more, King and Capital, has established a dedicated department of enterprise legal risk prevention and control.

Some other partners of King and Capital, Meng Bing, Jin Jie, Liu Bo and Liang Yali, also attended the seminar.
