Seminar on Latest Antitrust Developments and Case Studies in the Platform Economy Held Online

On May 17, a seminar on the latest anti-monopoly developments and case studies in the platform economy was held online, organized by the Competition Committee of the International Chamber of Commerce China National Committee (ICC China). Ms. Yu Wenwen, Associate Researcher of the Institute of Rule of Law, Beijing Academy of Social Sciences, and Mr. Jin Yi, Partner of Beijing King&Capital Law Firm, delivered speeches respectively. Yu Min, Secretary General of the ICC China National Committee, delivered a speech. More than 100 representatives from member organizations such as COSCO Shipping, Lenovo, Ali, Xiaomi and Amazon attended the meeting.

Researcher Wenwen Yu introduced the main body and role positioning of platform economy participants, legalized regulation of platform economy by regulators and special regulatory actions. She said that China's platform economy will gradually enter the stage of normalized regulation, and regulators will steadily push forward to achieve a standardized, transparent and predictable regulatory model. She also introduced in detail the rules and regulations involving platform economy in China's anti-monopoly law and anti-unfair competition law, and made an in-depth analysis of the types of unfair competition behaviors, such as data capture, mandatory target jumping, insertion of links, and infringement of intellectual property rights, etc., through typical cases. She suggested that Internet platform enterprises should strictly abide by laws and regulations and business ethics, establish a sound platform governance structure, and avoid monopolistic behavior and unfair competition.

 

Mr. Jin Yi introduced the anti-monopoly enforcement dynamics of the platform economy in the three major global anti-monopoly jurisdictions, including China, the U.S., and the EU. He said that the anti-monopoly regulation of platform giants in countries around the world has become increasingly stringent, with global Internet giants such as Google, Apple, Ali, and Tencent undergoing stringent investigations by the regulators in their jurisdictions respectively. He also analyzed in-depth the commonalities and differences between the new anti-monopoly initiatives of the platform economy in China, the U.S., and Europe, and suggested that enterprises actively build a platform anti-monopoly compliance management system and strictly comply with anti-monopoly related laws and regulations.

The meeting also featured exchanges and discussions on topics such as monopolization of data academic resources and the balanced relationship between platform economy development and regulation.
