King&Capital's Liang Yali participated in the drafting of "Evaluation of the effectiveness of compliance management system for small and medium-sized enterprises".

Recently, the group standard "Evaluation of the Effectiveness of Compliance Management System of Small and Medium-sized Enterprises" was approved and officially released by China Association of Small and Medium-sized Enterprises. Lawyer Yali Liang, senior partner of King&Capital Law Firm and director of King&Capital Criminal Defense Research Center, participated in the drafting of the evaluation standard and recently received the drafter's certificate issued by the Corporate Compliance Committee of China Association of Small and Medium Enterprises.



The Evaluation of Compliance Management System Effectiveness of Small and Medium-sized Enterprises aims to standardize the evaluation activities of compliance management system effectiveness of small and medium-sized enterprises, to guide and promote the construction of their compliance management system, to enhance their compliance management capability, to identify and prevent compliance risks, and to build a compliance culture. This is China's first group standard on the evaluation of the effectiveness of compliance management system of SMEs, which provides a comprehensive and detailed standardization of the evaluation method, evaluation process and evaluation indexes of the compliance management system of SMEs, and is an innovative initiative in the field of compliance construction of SMEs.

Small and medium-sized enterprises are increasingly becoming the vital force of national economy and social development, and have become an important foundation for building a modernized economic system and promoting the economy to achieve high-quality development. However, there is no targeted guidance standard for SMEs' compliance operation.

With the tightening of the regulatory environment at home and abroad, the continuous improvement of China's laws and regulations and policy system, and the continuous deepening of the reform of corporate compliance and non-prosecution, compliance has been raised to an unprecedented height in China. From a macro perspective, China is calling for the introduction of compliance management system evaluation standards for SMEs (especially "specialized, special and new" small giant enterprises).


The drafting of the Standard was led by the Enterprise Compliance Committee of China Association of Small and Medium Enterprises (CASME), with the participation of China National Institute of Standardization (CNIS) and Shanghai Zhihe Network Technology Co. The composition of the drafting expert group covers experts from judicial organs, domestic famous universities, experts from standard institutes, scientific research institutions, technology enterprises and law firms, including many members of the expert group for the development of ISO37301 international standard, all of whom have many years of experience in compliance theory and practice.

Previously, there was no standard in China that specifically evaluates the effectiveness of compliance management system for small and medium-sized enterprises. During the drafting process, the drafting expert group conducted a lot of exploration and research, broke through the difficulties of no precedent to follow, and filled the gaps of group standards in the domestic related fields.

The public release of the Standard to the society means that the evaluation of the effectiveness of the compliance management system of small and medium-sized enterprises will have rules to follow and evidence to rely on.
