On March 13, 2023, China Association of Interbank Market Dealers (CAIMD) announced the winners of 2022 NAFMII Research Program. It is reported that a total of 74 projects were submitted for the NAFMII Research Program in 2022, and 20 winning projects were selected after evaluation. The project of King&Capital Law Firm, "Research on Fiduciary Obligations in Bond Transactions of Asset Management Products" was selected as the winning project.

The host of the project is Dr. Park Gao Yuan of the Financial Business Department II, and the core members of the project team include Dr. Tang Jie and Rong Chen, in addition to summer interns from Nankai University, Tianjin University, Peking University and Zhejiang University also participated in the project under the guidance of the project.

Based on the accumulation of practice and theory of King&Capital Law Firm, the research group started from the international perspective to study the fiduciary obligation from different angles such as the identification of fiduciary relationship and the rights and obligations of fiduciary, and the feasibility of the application of the basic principles of fiduciary law in the investment of bond of asset management products, with an emphasis on solving the problem of the identification of the nature of the relationship between the subjects involved in the business of asset management and the path of regulation of the fiduciary obligation of the bond transaction of the asset management products. The study focuses on the identification of the nature of the relationship between the subjects involved in the asset management business and the path of regulation of fiduciary duty in bond transactions of asset management products.

In the future, the research group of King&Capital Law Firm will release the relevant research results at an opportune time, and we would like to invite industry experts to give us their advice. We will continue to focus on the non-litigation and litigation business of asset management products to enhance our professional capabilities!
