On June 6, 2023, King&Capital's "Food and Drug Crime Defense and Compliance" seminar was successfully held in the 22nd floor multi-purpose hall of King&Capital Law Firm.

The meeting was hosted by Mr. Tang Jianbin, senior partner of King&Capital Law Firm, and Mr. Wang Zhiqiang, Mr. Zhang Sijia, Mr. Lv Yan, Mr. Ma Tao, and Mr. Tang Jianbin of King&Capital Law Firm shared their views on the topic, and more than 1,500 lawyers from all over the country participated in the meeting through both online and offline channels at the same time.

Mr. Wang Zhiqiang shared the topic of "pharmaceutical sales enterprises as a perspective, see the lawyer to expand the criminal compliance of the point, line, face and body", Mr. Wang combined with typical cases, from the "point, line, face" three different dimensions of the analysis of the expansion of the criminal compliance business explains the key difficulties and risk prevention and control issues.

Mr. Zhang Sijia shared the topic of "How to realize effective defense for administrative offenders under the dualistic legislation model of violation and crime". Mr. Zhang introduced the experience of handling cases at the intersection of execution and punishment, and talked about the thinking and methodology of criminal defense for administrative offenders from the three perspectives of social harm, identification of antecedent unlawfulness, and identification of the nature of the act in the context of three cases.

Mr. Lv Yan shared the topic of "the convergence of execution and punishment in food and drug cases", in which Mr. Lv looked for the breakthrough point of the cases of convergence of execution and punishment from the handover of the workflow between the administrative organs and the criminal justice organs, and explored how to use the internal mechanism of the convergence of the organs for the lawyers, so as to achieve the purpose of the defense in a better way.

Mr. Ma Tao shared the topic of "Analysis of Pharmaceutical Industry Compliance on Advertising Compliance" online due to his overseas trip. Mr. Ma explained in detail the regulatory process, common violations, relevant laws and regulations, and new norms of "three products and one device" advertisements of pharmaceutical enterprises in terms of advertising compliance.

Mr. Tang Jianbin shared the topic of "The legal attributes of narcotic drugs from the revision of the Wuhan Desperate Poisoner case", in which Mr. Tang made an in-depth analysis of the legal judgments of the hot cases, and talked about the different legal applications of pharmacological narcotic drugs and non-pharmacological narcotic drugs, as well as the different situations of recognizing the drug crime and the crime of illegal business operation.

After the sharing, the attorneys discussed and exchanged views on the intersection of execution and punishment in the field of food and medicine as well as the control of narcotic drugs.
