As people's daily economic activities become more and more frequent and diversified, guidance on relevant legal knowledge is particularly important. Recently, the Chaoyang District New Era Civilization Practice Volunteer Team, Beijing Chaoyang District Justice Bureau, and Beijing King&Capital Law Firm co-organized the "Chaoyang District Legal Aid Volunteer Service" activity. As part of this activity, on July 28, 2023, Beijing King&Capital Law Firm assigned volunteer lawyers Wang Guannan and Luo Xueying to go to a dry rest home in Beijing to carry out volunteer service of legal literacy for military families and veterans.
Before carrying out the service, the two lawyers found in the preliminary research that with the continuous growth of people's wealth, the distribution of property in marital relationship, the inheritance of property of the elderly and other issues gradually appeared and became a difficult problem for many families. In response to the actual needs of the people, Mr. Wang Guannan and Ms. Luo Xueying explained the inheritance section and marriage and family section of the Civil Code with cases respectively.
The topic of Mr. Wang Guannan's sharing was the Inheritance Part of the Civil Code. Combined with illustrations, Mr. Wang explained issues such as the beginning of inheritance, conditions for inheritance, distribution of property, and wills, and interacted with the participants in the way of case law and questions, so as to help the audience understand the inheritance issues, and deepen the audience's impression of the relevant knowledge points.
Ms. Luo Xueying, based on the provisions of the Marriage and Family Part of the Civil Code and other laws and regulations, combined with the relevant case law, explained the issues commonly encountered in practice, such as: "How to divide the real estate purchased by the parents after the marriage of the children in whole or in part when the children get divorced?", "How to divide the real estate purchased by the parents after 100 years, when the children get divorced? The court has also made recommendations on the following questions: "How to divide the property inherited by the children during the marriage after the parents' death?", "How to divide the property inherited by one of the parents before the marriage? , "One party paid the down payment with personal property and took out a bank loan before marriage, and then used the couple's joint property to repay the loan after marriage, how will the property be divided in the event of a divorce?" "If one party buys a house before marriage and adds his/her spouse's name after marriage, can his/her spouse claim for a 50/50 split?" Four legal practice issues are explained.
The content of this volunteer service is comprehensive and closely related to people's livelihood. After the explanation, Wang Guannan and Luo Xueying answered the on-site questions in detail, and the two lawyers patiently explained to the elderly who came to consult with them, and made professional analysis and explanation for the house inheritance issue, which was widely praised by the participants.
