From December 28, 2023 to January 1, 2024, the “Southern Criminal Defense Skills Practical Training on Trial Examination” was successfully held in Gulangyu Island, Xiamen City, Fujian Province, with 40 trainees from all over the country attending this practical training. Tian Wenchang, Honorary Dean of the Institute of Criminal Defense of Northwest University of Political Science and Law and Honorary Director of King&Capital Law Firm, Men Jinling, Vice Dean of the Institute of Criminal Defense of Northwest University of Political Science and Law, Associate Professor of Chinese Academy of Social Sciences and Part-time Lawyer of King&Capital Law Firm, and Liang Yali, Vice Dean of the Institute of Criminal Defense of Northwest University of Political Science and Law, President of the Beijing Branch of the Institute of Criminal Defense of Northwest University of Political Science and Law and Senior Partner of King&Capital Law Firm were invited to participate in this activity and acted as the instructor. The activity was held in Beijing and served as a practical training instructor.
This criminal defense skills training activity lasted three days and three nights, in accordance with the training mode created by the Northwestern University of Political Science and Law's Institute of Advanced Studies in Criminal Defense, which is “identity is not divided into primary and secondary, the answer is not standardized, everyone is highly brainstorming, and the resources are fully shared”, nine senior instructors, including attorneys Men Jinling and Liang Yali, combined with their own rich experience in criminal defense practice, and adopted the following methods to train the instructors. Criminal defense practice experience, take “open small class, interactive sharing, combat communication” method, through the “theoretical combing, law refinement, case analysis, simulation training, skills sharing, review and comment” way, systematic application of the Through the method of “theory refining, case analysis, simulation training, skill sharing, review and comment”, we systematically apply the “clinic-style” practical training method, and focus on the core skills of lawyers' court appearance from the perspective of criminal procedure practice - examination in court.
Tian Wenchang made the opening mobilization
In the three days and three nights of practical training activities, December 29th arranged a series of “heavy drama”. At 9 o'clock in the morning, Tian Wenchang, honorary director of Northwest University of Political Science and Law, honorary director of King&Capital Law Firm, began to mobilize the class, he believes that the evidence has a pivotal role in criminal cases, but also one of the keys to achieve good results in the defense, and at the same time, he also puts forward a strict requirement for the trial examination of the training course.
Men Jinling gave practical training
Afterwards, Mr. Men Jinling, deputy director of the Institute of Advanced Criminal Defense of Northwestern University of Political Science and Law, associate professor of Chinese Academy of Social Sciences, and part-time lawyer of King&Capital Law Firm, made an explanation of the principle of trial cross-examination, and she believed that we should hold on to the evidence of the “three sexes and two forces” to make judgments, and that for the evidence without relevance or legitimacy, the qualification of its evidence should be excluded through cross-examination. For evidence that does not have the relevance or legitimacy, should be excluded through the evidence qualification; for evidence that has relevance and legitimacy, should also be from the authenticity of the evidence, evidence and evidence of the facts to be proved through the two aspects of the substantive connection between the evidence to weaken, shake its proving power.
In the afternoon, Mr. Liu Renqi, executive director of the Institute of Advanced Studies in Criminal Defense of Northwestern University of Political Science and Law, explained the skills of trial examination, he mainly from the jurisprudence, methodology, and introduced the major types of trial examination.
Liang Yali gave practical training
At 6:30 p.m., the course of “Defendant's Statement Examination” began, the director of King&Capital Criminal Discernment and Protection Research Center, Ms. Liang Yali, guided the students to start the group brainstorming, the students wrote down their own questions about the part, and several instructors answered the questions of the students one by one. Subsequently entered the simulation exercise, the students will learn the content of the practical application of the simulation, the tutors review and make comments.
