Recently, Mr. Yang Haiming, a partner of King&Capital Law Firm, was awarded the decision of the Supreme People's Court not to approve the death penalty in a death penalty review case.

　　The case was assigned by the Legal Aid Center of the Ministry of Justice. After accepting the assignment, Mr. Yang went to the Supreme People's Court in time to copy the case file of the original trial, and analyzed the case file carefully with the content of the verdict of the first trial and the ruling of the second trial.

　　Although it is a legal aid case, but Yang Haiming lawyers did not relax on their own requirements and standards of the case, respectively, from the facts of the case, the criminal case of the standard of proof as well as the defendant sentencing circumstances and other perspectives of the case was analyzed comprehensively, that the defendant's death sentence should not be approved. After that, Yang Haiming communicated with the judge and submitted a detailed defense opinion. Eventually, the defense opinion was adopted by the Supreme People's Court, which ruled that the defendant's death sentence should not be approved, and sent the case back to the court of second instance for retrial.
