From 20 to 22 December 2024, 30 lawyers from all over the world who are interested in professional improvement of criminal defence gathered at King&Capital Law Firm in Beijing to participate in the criminal defence training on ‘The Questioning of Physical Type of Evidence’ hosted by the Institute for Advanced Studies in Criminal Defence of Northwestern University of Political Science and Law.


The opening ceremony was presided over by Liu Renqi, Executive Dean of the Institute of Advanced Studies in Criminal Defence of Northwestern University of Political Science and Law and Vice Dean of the School of Criminal Law, with Tian Wenchang, Honorary Dean of the Institute of Advanced Studies in Criminal Defence of Northwestern University of Political Science and Law and Honorary Director of Beijing King&Capital Law Firm, Chu Changzhi, Managing Partner and CEO of Beijing King&Capital Law Firm, and Liang Yali, Deputy Dean of the Institute of Advanced Studies in Criminal Defence of Northwestern University of Political Science and Law and Liang Yali, Deputy Director of the Advanced Institute of Criminal Defence of Northwestern University of Political Science and Law and Director of the Criminal Defence Research Centre of Beijing Kyoto Law Firm, delivered a welcoming speech.

‘In the middle of the training, you have to carry out all procedures strictly, don't slack off and don't be negative.’ Tian Wenchang, Honorary President of the Advanced Institute of Criminal Defence of Northwestern University of Political Science and Law and Honorary Director of Beijing King&Capital Law Firm, pointed out that the training model created by the Advanced Institute of Criminal Defence of Northwestern University of Political Science and Law after more than three years is hard-won, and he hoped that everyone would personally feel the effect of this kind of training in the middle of the training, and give full play to their cognitive and critical abilities, to accept the criticisms of other people, and be brave enough to criticise Others, so as to build yourself into a professionally trained criminal defence lawyer with professional skills and a formalised mode of operation.

He said that King&Capital Law Firm has carried out 11 training courses based on the training model of Northwest University of Political Science and Law Advanced Institute of Criminal Defence, in addition to the main office in Beijing, and at the same time with the linkage of each branch, has been held in the King&Capital Dalian Branch and the King&Capital Chongqing Branch respectively. In the end, he hoped that everyone could learn something here and get the maximum improvement of criminal defence skills.

‘We selected cross-examination as the topic of this training from more than a dozen training boards because cross-examination is always one of the most intense aspects in the middle of the court debate process.’ Liang Yali, director of the Advanced Institute of Criminal Defence of Northwestern University of Political Science and Law and the Criminal Defence Research Centre of Beijing King&Capital Law Firm, introduced that how to review the evidence, how to review the evidence before the court, and how to effectively express the opinions of cross-examination in the court, etc. are all the contents that the course is going to focus on, and at the same time, the review of the several types of evidence such as the documentary evidence, the physical evidence, the electronic data, and the investigation transcripts will be the focus of attention of this training.

The course set up a number of links to the topic, including ‘the principle of physical evidence, the status quo and problems’ ‘physical evidence, documentary evidence, transcripts of evidence and the principle of norms’ ‘physical evidence, documentary evidence, transcripts of the skills and taboos of the evidence ‘Electronic Data Examination in Real Case Files’ “Tips and Taboos of Electronic Data Examination” and so on.

In the evening lecture, Mr. Tian Wenchang and Mr. Zhu Tonghui delivered the keynote speeches of ‘Status quo and reflection: the concept and principle of criminal defence’ and ‘Types of electronic data in the case and the strategy of reviewing them layer by layer’. From the historical origin of the concept of the rule of law and the idea of the rule of law, Mr Tian Wenchang talked about the difference and connection between the ‘rule of law’ and the ‘legal system’, and elaborated in detail on the ten misunderstandings that have existed for a long time on the concept of criminal procedure, as well as the conflict of concepts that the misunderstandings originated from, and the solution ideas and suggestions. Associate Professor Zhu Tonghui explained in detail the types and methods of electronic data defence, the types of electronic data in the case and the method of reviewing and defending the case, and the concept and methods of layer-by-layer defence.





In the simulation session, the trainees played the roles of public prosecutor, presiding judge and defender to conduct practical exercises, and the lecturers and observers commented on the simulation exercises and provided on-site guidance, answered questions and summarised one by one.


At the end of the course, the lecturers issued a certificate of completion to the students issued by the Institute of Criminal Defence of Northwestern University of Political Science and Law, and the three-day workshop on ‘Examination of Physical Evidence’ was successfully completed.
