On May 25, 2025, sponsored by Yunnan Provincial Lawyers' Association and co-organized by Alumni Association of Northwestern University of Political Science and Law, Alumni Association of Southwestern University of Political Science and Law in Yunnan Province, Alumni Association of China University of Political Science and Law, Alumni Association of Central South University of Economics and Law, Alumni Association of East China University of Political Science and Law in Shanghai, the fourth Yunnan-Five Courts of Law Famous Lecture Theatre - “Focusing on the New Development of Theory and Practice at the Crossroads of Civil and Criminal Law” was successfully held in Kunming. “Focus on civil and criminal cross-cutting areas of theory and practice of new developments in the legal business training and exchange activities were successfully held in Kunming. Yunnan Provincial Lawyers Association President Wan Li attended and delivered a speech, Vice President Zhang Hui, Xu Guogong participated in the activities. Tian Wenchang, doctoral supervisor of Northwest University of Political Science and Law, honorary president of Northwest University of Political Science and Law Advanced Institute of Criminal Defense, and honorary director of Beijing King&Capital Law Firm, was invited to attend the event and gave a lecture on the theme. 500 legal colleagues from all over the country gathered here, and more than 5,000 people participated in the live synchronous video learning on the Internet, with a total of more than 30,000 visits.
“The reason why our rule of law construction, our judicial activities, and our lawyers' defense have stumbled and struggled along the way is that one of the most important reasons among many is the lagging concept.” Tian Wenchang pointed out in his lecture titled “Out of the Misunderstanding of Criminal Procedure Concepts,” which includes “difficult” problems such as denying the principle of presumption of innocence by seeking truth from facts, denying the presumption of innocence by not wrongly convicting a person, not giving the suspect or the defendant the right to read the file, and the inertia of the inversion of the burden of proof.
He said that in recent years, some scholars openly issued an article to the criminal-civilian cross-case is a pseudo-proposition, and further proposed that criminal fraud and civil fraud has no boundaries, “we say that the boundaries are very difficult to delineate, is indeed a difficult problem. But if we say there is no boundary, it will easily lead to the criminalization of civil liability.”
This issue invites Professor Sun Xianzhong, member of the Chinese Academy of Social Sciences, first-class researcher and doctoral supervisor, Professor Fu Yuming, professor of criminal law at Northwestern University of Political Science and Law, doctoral supervisor, director of Northwestern University of Political Science and Law's Scientific Research Center of Criminal Law, and director of Northwestern University of Political Science and Law's Institute of Corporate Compliance, and Professor Fu Yuming, vice president of Northwestern University of Political Science and Law's Advanced Research Institute of Criminal Defense, postgraduate Yang Wenbin, Director of Shanghai Duan and Duan (Hangzhou) Institute, served as the guest speaker and gave lectures on the theme of “Reflections on the Principle of Systematization of Civil Law on the Guiding Role of Analysis and Adjudication of Civil Cases”, “Criminal Governance of Autonomous Vehicle Accidents”, and “Dispute Discussion on Tax-Related Criminal Cases under the New ‘Interpretation’, respectively.
Yunnan-Five Courts of Law Lecture Forum is a regular training activity promoted by the alumni associations of China University of Political Science and Law, Southwest University of Political Science and Law, East China University of Political Science and Law, Central South University of Economics and Law, and Northwest University of Political Science and Law and organized by Yunnan Provincial Lawyers Association.
