On June 12, 2026, the results of the essay contest for the “Public Interest Protects the National Unified Market—The Third Symposium on High-Quality Development of Procuratorial Public Interest Litigation,” jointly organized by the Henan Provincial People’s Procuratorate, *China Prosecutor* magazine, the School of Law at Renmin University of China, the Institute of Procuratorial Public Interest Litigation at Zhengzhou University, and the Research Center for Procuratorial Public Interest Litigation at Northwest University of Political Science and Law, were officially announced.

Centered on the theme “Public Interest Protection for the National Unified Market,” the symposium received a total of 924 submissions from procuratorial organs, universities, law firms, and other institutions across the country since its launch in February 2026. Following rigorous evaluation by a panel of experts, 30 first-prize, 60 second-prize, 90 third-prize, and 120 excellence-award entries were selected. Among them, the paper titled “A Study on Procedural Coordination Issues in Antitrust Civil Public Interest Litigation to Safeguard the Unified National Market,” co-authored by Attorney Jin Yi of Beijing King&Capital Law Firm and Prosecutor Shen Wei of the Xianyou County People’s Procuratorate in Fujian Province, stood out in the fierce competition thanks to its solid theoretical foundation and distinct practical orientation, winning First Prize (ranked 12th).

Centered on the procedural conflicts and coordination between antitrust civil public interest litigation and administrative law enforcement, this award-winning paper—with the goal of safeguarding the unified national market—conducts an in-depth analysis of the structural contradictions between the two at three levels: priority in initiating proceedings, overlapping liability, and the paradox of mutual use of evidence and procedural incentives. By examining the “quasi-public authority” nature of public interest litigation and drawing on international experience, the authors proposed a tiered and coordinated procedural framework, a mechanism for balancing liability, and graduated rules for evidence isolation. These proposals aim to reconcile administrative authority with judicial remedies, resolve conflicts over overlapping liability and incentives, and provide legal safeguards for a fair competitive order within the unified national market.

This award marks yet another significant achievement by Attorney Jin Yi and Prosecutor Shen Wei in the field of research on public interest litigation initiated by the procuratorate. It highlights the positive outcomes of cross-regional and cross-industry legal collaborative research and contributes practical insights to the improvement of China’s antitrust civil public interest litigation system and the rule-of-law-based development of the unified national market.
