In recent years, due to the lack of knowledge of Chinese law, especially the criminal law, several large multinational corporations, such as Siemens, Walmart and Rio Tinto Group, were investigated by Chinese Authorities. Some senior management personnel of multinational corporations were prosecuted and sentenced to prison and some corporations were served with large fines.

When facing criminal prosecution, the legal department of multinational corporations and foreign law firms will become at their wit’s end, and traditionally, the Chinese lawyers, for whom English can be their working language, usually are not good at dealing with criminal cases. At King and Capital, a legal team, consisting of Mr. Huang, Ms. Xiang and other lawyers was set up in recent years, aiming at providing international high-end legal services for multinational corporations, regarding senior management personnel’s criminal offense and criminal risk control.

 

 

 

 

      

As the organization providing services to the German enterprises in Greater China, the German Chamber of Commerce has realized the importance of criminal risk control for its members. In order to provide better services and ensure the good operation of German enterprises in China, after a long time of investigation and comparison, the German Chamber of Commerce appointed King and Capital to provide training for its members regarding criminal risk control.

The lecture consisted of six parts, which included “Case analysis of the multinational corporations’ senior management personnel’s criminal offense”, “Common forms of criminal cases in multinational corporations”, “Analysis of the reasons for the senior management personnel to commit crime”, “The prevention of the crime committed by the senior management personnel”, “Introduction of relevant criminal procedure” and “The particularity of the criminal procedure for the crimes committed by foreigners in China.” After the lecture, Mr. Huang and Ms. Xiang answered questions raised by the senior management personnel from German enterprises.
