On the afternoon of December 15, 2023, Mr. Zhang Libin, Managing Partner of Foreign-related Business Department of Beijing King&Capital Law Firm, successfully hosted the online launch of "Annual Observation on Energy Dispute Resolution in China (2023)" at the Beijing Arbitration Commission.
In this conference, Mr. Zhang Weihua, Commercial Vice President and General Counsel of United Energy Group, served as the publisher, while Ms. Jiang Na, Legal Director of Hip Hop New Energy Group, and Mr. Dong Chunjiang, Senior Partner of Beijing Lantai Law Firm, served as the commentators. Mr. Zhang Weihua firstly briefly introduced the development trend and dispute overview of the energy industry in 2022, shared the important legislation of the energy industry in 2022 and typical cases from different background perspectives, and discussed the hot issues of the industry, such as the repeal of the No. 35 document on mining rights and third-party funding of energy disputes. Driven by the global energy green transition and geopolitical volatility, he said that energy industry disputes will grow significantly, providing unprecedented opportunities for arbitration institutions, which will demonstrate their key role in resolving complex energy disputes.
At a time when the global energy industry is witnessing historic changes, the release of Beidu's annual Energy Dispute Resolution Insight Report has attracted widespread attention. The in-depth analysis of the report's author, Mr. Zhang Weihua, and his brilliant speech at the launch won unanimous praise from the participants. Through five representative cases, Mr. Zhang Weihua vividly demonstrated the latest legal trends and challenges in the energy industry. Ms. Jiang Na, based on her 14 years of legal experience in the new energy industry, provided precise and insightful comments on the report. Mr. Dong Chunjiang, as a senior expert and barrister in the power industry, also provided insightful views and suggestions on the report. His comments not only demonstrated his expertise in the power sector, but also reflected his insight in resolving complex disputes.
In the final stage of the launch, the moderator, Mr. Zhang Libin, provided an expert summary of the presentations made by the reporter and critics, giving important extended additions to the key issues involved in the cases provided by Mr. Zhang Weihua. The release of this report is of great significance in understanding and predicting the future direction of the energy industry.
Mr. Zhang Libin concluded by pointing out that at the just-concluded 28th World Climate Change Conference (COP28), delegates reached a consensus, historically, on the phasing out of fossil fuels as an available option. Against this backdrop of change, legislative regulation of the energy sector and dispute resolution mechanisms (including judicial litigation, arbitration with quasi-judicial effect and other alternative dispute resolution methods) will provide energy law professionals with a broader career development space. Particularly in the area of cross-border energy trade and investment, there will be a huge market demand for foreign services in the areas of ADR and dispute resolution.
