Seminar on Major Difficult Cases, Phase I: Alleged Misappropriation of Funds by the Chairman of a Listed Company

On the afternoon of April 2, 2025, the first session of “Seminar on Major and Difficult Cases” 2025 was successfully held at King&Capital Law Firm, hosted by the Criminal Division.


The seminar centered on the case of the chairman of a listed company who was charged with misappropriation of funds, and discussed the key points and strategies for the defense of cases involving listed companies and misappropriation of funds by examining the issues of factual determination, application of law, and legitimacy of procedures in the case. The seminar was conducted by Tang Wanzhuo, a lawyer of King&Capital Law Firm, and Zang Desheng, Men Jinling, Xu Ying, Zhu Yalin, senior partners of King&Capital Law Firm, Yang Haiming, partner, and Ding Wei, attorney at law, participated in the discussion of the case.


Mr. Tang Wanzhuo introduced the basic facts of the case, points of contention and the reasons for the decision by comparing the funds and the judging documents of the first and second trials.


Based on his rich trial experience, Mr. Zang Desheng elaborated his defense viewpoints on the object of the crime of misappropriation of funds, the basis for determining the misappropriation of funds that has not been repaid for more than three months, and the statute of limitations of this case.


Based on her profound theoretical knowledge of litigation law, Ms. Men Jinling provided new defense ideas in terms of the doubtful facts of the accounts receivable claim, the fact that the judgment of the second instance should not be directly changed if the factual basis of the judgment has been changed, and the distinction between the essential facts and the adjudication supporting facts.



Mr. Xu Ying, Mr. Zhu Yalin, Mr. Yang Haiming and Mr. Ding Wei shared their views on the obstacles in fact finding, confusion in law application and legality of procedure in this case.


The first phase of the Seminar on Major Difficult Cases was successfully concluded in a warm atmosphere.
